Former President Donald Trump’s legal team reportedly requested Monday that Judge Juan Merchan allow a motion to be filed to overturn Trump’s criminal conviction in the hush-money trial in Manhattan following the Supreme Court’s ruling on presidential immunity.
On Monday, the Supreme Court ruled that a former president has immunity for official acts that are conducted while a president is in office.
According to Fox News, Monday’s 6-3 ruling by the Supreme Court significantly narrows the Justice Department’s case against him for actions taken following the 2020 election and for his alleged role in the storming of the U.S. Capitol on January 6, 2021. The Supreme Court’s decision also sent the case back to the lower courts to determine what part of Special Counsel Jack Smith’s indictment still remains against the former president.
Fox News reported that Trump’s lawyers filed a motion to dismiss the verdict reached by a New York jury in Manhattan District Attorney Alvin Bragg’s case against the former president within hours of the Supreme Court’s ruling on Monday. Trump was previously convicted on 34 counts of falsifying business records.

According to a source cited by The New York Times “with knowledge of the matter,” Trump’s lawyers are requesting that the former president’s upcoming sentencing hearing on July 11 be postponed until Merchan can consider the new motion being filed by the defense in the Manhattan case.
A source confirmed to Fox News that Merchan had received a letter from Trump’s lawyers regarding the new development in the case. According to Fox News, the letter requests permission for Trump’s lawyers to file a motion to vacate the jury’s verdict based on an argument that evidence was included against Trump that should not have been used against the former president based on the Supreme Court’s clarification of presidential immunity.
